TERMS AND CONDITIONS OF SERVICE

Arqdecoskp is a virtual brand. It develops 3D models for independent, professional and amateur artists on digital art and design programs. You are required to create a user account and pay an access fee that may be one-time or may be a subscription fee. Access to and use of the Services, whether accessed with or without payment, are subject to the terms and conditions of this agreement.

By purchasing or subscribing to the Services provided by arqdecoskp or creating a user account, you agree to the provisions of arqdecoskp's Privacy Policy available at arqdecoskp.com/privacy-policy/ (the "Privacy Policy"), all of which are incorporated herein by reference. This Agreement and Privacy Policy contain important legal information, including the exclusion of certain warranties and remedies. You are responsible for reviewing this Agreement and the Privacy Policy. arqdecoskp's Terms and Conditions and Privacy Policy may be modified from time to time. arqdecoskp will take steps to provide notice on the Site of changes to the Terms and Conditions and Privacy Policy. Amendments or changes to the Terms and Conditions or Privacy Policy will be effective ten days from the date the changes are posted. You are responsible for reviewing any changes to the Terms and Conditions or Privacy Policy.

1. USER ACCOUNTS

In order to gain access to the Services, you must create an account on arqdecoskp ("User Account"), this will allow you to access the files ("Supplementary Material") identified as free. You must pay the corresponding fees for access to the services you request in case access to them is linked to a paid process. By creating a user account, you represent and warrant that the information you provide is correct and complete. You may never use another account or share your user account with others.

You are responsible for maintaining the security of your password and will be solely responsible for all activity that occurs under your User Account. If you believe that your User Account has been breached or used in any unauthorized manner, you must notify an arqdecoskp representative immediately. arqdecoskp is not liable for any damages or losses caused by unauthorized use of your User Account. You, however, may be held liable for any damages incurred by arqdecoskp resulting from unauthorized use of your User Account.

Arqdecoskp may delete your user account at any time if it considers that you have used your account improperly, violated any point of this Agreement or any issue related to the Privacy Policies. In case of account deletion due to suspicious or improper activity, you will be notified by email forty-eight (48) hours prior to the deletion of your account. You may respond to such notification within the indicated period (not later) before the deletion of your account, for a more advanced study of your case in case you consider that the deletion of the account is not justified.

ACCESS TO PREMIUM

arqdecoskp offers paid access specialist models. These can only be accessed by contracting this service through a one-time payment or subscription account. To access them you agree to pay the access or subscription fees and other charges incurred in connection with your User Account (including any applicable taxes if applicable) at the rates in effect when the charges were incurred. The rates for access to the services may change at any time without prior notice.

Access to a premium account or paid protected content (One-time or subscription) from your user account may be revoked at any time if you are deemed to be in breach of the Site rules.

SUBSCRIPTION ACCOUNTS

Arqdecoskp offers services on a subscription fee basis in accordance with the available pricing and payment rates posted on XXXXXXXXXXXXXX (the “Subscription Fees”). You agree to pay subscription fees and other charges incurred in connection with your User Account (including any applicable taxes if applicable) at the rates in effect when the charges were incurred. Fees for access to the School’s services may change at any time without notice.

Access to a premium account or paid protected content (One-time or subscription) from your user account may be revoked at any time if you are deemed to be in breach of the Site rules.

ACCESS RATES TO PAID SERVICES

You agree to pay fees for access to paid services, as well as other charges incurred in connection with your User Account (including any applicable taxes, if applicable) at the rates in effect when the charges were incurred.

Arqdecoskp may modify the access fees to the paid access services at any time without prior notice. In the event of any change in these fees, your user account may be subject to modifications regarding access privileges to certain areas or services of the Website. Arqdecoskp will publish and notify its users by email, alert messages on the Website or posts on social networks of these modifications at least forty-eight (48) hours before these changes are applied.

CURRENCY AND LOCAL CURRENCY EXCHANGE RATES

The currency used for arqdecoskp's business processes is the US Dollar (USD). All prices published on the website are governed by this currency.

The automated payment processes on the arqdecoskp Website allow registered users to make payments using a credit or debit card that allows international payments over the Internet or with their Paypal account. The Website's payment system will automatically convert payments to your local currency according to the international rates in effect at the time of making your payment.

Confirmation of payments in local currency is manual. When purchasing one or more arqdecoskp Payment services in local currency, you must complete a form with the transaction details. These details will be processed by arqdecoskp and once payment is confirmed, these privileges are activated in your user account. This process is automated.

All training materials, content, organization, graphics, design, compilation, translation, digital conversion and other related matters contained in the Site are protected (including but not limited to intellectual property) rights.

The copying, modifying, distributing, transmitting, displaying, selling, licensing, using, publishing or creating derivative works by you of such matters or any part of the Site, except as expressly permitted by the Agreement, is strictly prohibited. You do not acquire ownership rights in any content or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any rights in such information and materials.

DOWNLOAD MATERIALS

arqdecoskp may make certain training materials available through download services operated within the Website or through Third Parties. You may not sell, share, promote or copy these files without arqdecoskp's permission.

TRACKING AND MONITORING

Arqdecoskp implements technology and procedures to track the use of the Site and its Services, including monitoring and control related to individual user accounts. In addition to other data collected, arqdecoskp may track the number of videos viewed, the time spent viewing, and other information related to content viewing activities.

By using the Site and Services, you consent to the monitoring and surveillance of your use of the Site and Services. If arqdecoskp determines, in its sole discretion, that you have engaged in any activity in violation of these Terms and Conditions or the Privacy Policy, arqdecoskp may immediately terminate your account. You will not be entitled to a refund for any fees paid. arqdecoskp also reserves all legal rights, claims and causes of action it may have against you.

arqdecoskp may mention products that belong to or are distributed by other companies or brands, these may be trademarks or service marks of their respective owners. These trademarks and / or service marks may not be reproduced without the express written consent of the respective trademark or service mark holder.

Arqdecoskp is not responsible for the availability of services or products of these companies or brands.

11. DURATION AND TERMINATION OF SUBSCRIPTION SERVICES

This Agreement will be effective as of the date you create your user account. The term of the Agreement for billing purposes will begin as of the Subscription Date. By selecting Services, you may subscribe on a monthly, annual or one-time basis depending on the service. In the case of a subscription, your subscription will automatically renew unless we cancel, you cancel or notify us via email (receipt of which must be confirmed by email response from us) of your decision to terminate your subscription.

Subscriptions once purchased on the site are automatically renewed according to what your plan indicates: Monthly or Annual.

You must cancel your subscription before it renews in order to avoid billing of subscription fees for the renewal term to your credit card or Paypal account.

CANCEL PAID SERVICES AT USER'S REQUEST

You may cancel subscriptions in your user account at any time through the Website platform itself or by requesting this process by email: contacto@arqdecoskp.com In the event that it is via email after receiving the notice, the subscription privileges will be cancelled for the next billing cycle of your services. You will not receive a refund for the fees paid to arqdecoskp. To access these services again, you must contract them again.

CANCEL PAID SERVICES

Arqdecoskp may terminate or remove paid content access privileges from your account, with or without cause and without notice, if it determines that you have violated the terms of use of the Website Services in any way. If you believe that your user account has been terminated in error, please contact arqdecoskp at: contacto@arqdecoskp.com For example, arqdecoskp may terminate a user account's paid service access privileges if it determines that you have provided others with access to training materials using your user account.

If it is determined by arqdecoskp, in its sole discretion, that your User Account was terminated in error, arqdecoskp will provide you with access to the Services free of charge for the period of time in which your User Account was terminated. This shall be the sole and exclusive remedy available to you for any termination in error. In the event arqdecoskp terminates privileges or deletes your account for cause, determined in arqdecoskp's sole discretion, you will not receive a refund for any Subscription Fees or Services purchased or paid to arqdecoskp.

REFUND OF PAYMENTS

By using the website and contracting its paid services, you accept these conditions. It is up to you to make use of the published content. No refunds will be made for access, services or paid access privileges due to lack of use. For example: You open a user account, contract a monthly subscription service, but during that month you cannot view the content due to personal reasons beyond arqdecoskp's control, in this case arqdecoskp is not obligated to refund your amount or extend your account access so that you can access the selected content.

Arqdecoskp does not offer a refund for payments made by you when contracting a paid access service. Under no circumstances will any type of refund of the amount paid be established.

By cancelling a subscription privileges service or any other paid access service from arqdecoskp you may lose access to that content immediately. In the event that this occurs by mistake you may contact arqdecoskp at contacto@arqdecoskp.com to present your case which will be studied by arqdecoskp, and the corresponding measures determined solely under the judgment and consideration of arqdecoskp will be taken to resolve this case. Under no circumstances is arqdecoskp obliged to return the amount paid.

LIMITED LICENSE

By subscribing to the Services, arqdecoskp grants you a limited, non-exclusive license to access the training materials through the arqdecoskp website.

You are not authorized to:

Share your user account with others;

Allow more than one person to access a user account;

Copy, modify, distribute, capture or save locally any of the training materials unless explicitly authorized by arqdecoskp;

Remove any copyright or proprietary notices (including supplementary materials);

Circumvent or attempt to circumvent any encryption, security code, or other protection used in connection with the materials;

Use the Services for illegal purposes;

If you have reason to believe that a user has posted content that is obscene, pornographic, violates a third party's intellectual property rights, or otherwise violates the terms of this Agreement, you may contact arqdecoskp at: contacto@arqdecoskp.com and request removal of the content or use other procedures available through the forum to request removal. Removal requests due to intellectual property infringement should be directed to contacto@arqdecoskp.com or from the forum's reporting system itself and include the following:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

Identification of the work whose copyright has been violated,

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.

Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

DISCLAIMER OF WARRANTY

ARQDECOSKP DOES NOT WARRANT THAT THE TRAINING MATERIALS OR SERVICES OFFERED IN CONNECTION THEREWITH WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE CONTENT OF THE TRAINING MATERIALS IS ACCURATE. arqdecoskp makes no warranties, express, implied, or arising from custom or trade usage, in connection with the training materials or services, and without LIMITING THE GENERALITY OF THE FOREGOING, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DISCLAIMS ALL IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT PERMITTED BY APPLICABLE LAW.

LIMITATIONS OF LIABILITY

IN NO EVENT SHALL ARQDECOSKP AND/OR ITS AFFILIATES, PARTNERS, AGENTS, EMPLOYEES, LICENSORS OR SUPPLIERS BE LIABLE FOR ANY PUNITIVE, CONSEQUENTIAL, OR MULTIPLE DAMAGES, OR LOST PROFITS OR OTHER SPECIAL, DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING ANY DAMAGES RESULTING FROM LOSS OF BUSINESS ARISING OUT OF OR IN CONNECTION WITH THE MATERIALS OR RELATED SERVICES, EVEN IF ARQDECOSKP HAS PREVIOUSLY ADVISED YOU OF THE POSSIBILITY OF SUCH DAMAGES OR IF SUCH DAMAGES WERE FORESEEABLE. IN ANY EVENT OTHER THAN A BREACH OF THE ASPECTS OF THIS AGREEMENT, ARQDECOSKP'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL BE LIMITED TO THE AMOUNT PAID BY THE USER to contract or acquire the services of the Website.

TERRITORY RESTRICTIONS

The Services may not be available in some territories due to certain national or international restrictions. By using or subscribing to the Services, you represent and warrant that you are authorized under all applicable laws to access the Services.

COMPENSATION

You agree to defend, indemnify and hold harmless arqdecoskp, its officers, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt and expenses (including, but not limited to attorney's fees) arising from:

Your violation of this Agreement or the Privacy Policy;

Your violation of any third party right, including without limitation any copyright, property or privacy right; or

Any other claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive the termination of this Agreement and your use of the Services.

NO RESIGNATION

Again, you are responsible for reviewing the arqdecoskp Terms and Conditions as well as the arqdecoskp Privacy Policy. If you do not agree with any of the above terms or the Terms and Conditions or the Privacy Policy, do not proceed with using the arqdecoskp website, training materials, and do not access its Services.
